Terms of service

    Effective Date: October 2, 2025

    These Terms of Service ("Terms") govern your use of Alethia's websites, the Sensory Intelligence Quotient (SiQ™) assessment, demonstrations, workshops, and related online services (together, the "Services"). For enterprise deployments of the Sensory Intelligence™ platform and professional services, the governing terms are the applicable Master Services Agreement (MSA) and Data Processing Addendum (DPA) between Alethia and the customer; if there is a conflict, the MSA/DPA controls for those deployments.

    By using the Services, you agree to these Terms.

    1. Who we are

    Alethia provides Sensory Intelligence™ services that help organizations perceive pattern emergence and act with foresight. The Sensory Intelligence™ platform operates through six integrated modules:

    • Core – Cross-dimensional pattern detection and knowledge graph
    • Edge – Distributed signal capture for internet of things (IoT) and field data
    • Pulse – Real-time monitoring and alerting
    • Flow – Data integration and orchestration
    • Studio – Design and simulation environment
    • Lens – Role-aware interface and contextual delivery

    The platform analyzes signals across the Five Dimensions of Perception (Temporal, Spatial, Behavioral, Systemic, Economic) to surface patterns and recommended actions.

    2. Using the services (Web, assessment, demonstrations)

    • You must be at least 13 (or the minimum age in your country) to use the Services; users under 18 require parental or guardian permission.
    • Provide accurate information, keep credentials confidential, and do not share your account.
    • If you use a corporate email/account, your organization may control the account.
    • Acceptable Use (summary): Do not misuse the Services, interfere with or disrupt them, attempt to bypass security or rate limits, reverse-engineer underlying components (except as permitted by law), or use outputs to build competing services. Do not submit unlawful, infringing, or harmful content, malware, or data you are not authorized to disclose.

    3. Enterprise deployments (MSA/DPA)

    Enterprise customers access the Sensory Intelligence™ platform under a separate MSA and DPA that govern ordering, subscription scope, service levels, data processing, confidentiality, intellectual property, security, retention, and deletion. As between Alethia and the customer, Customer Data is owned by the customer; Alethia processes it solely under the customer's instructions and the DPA.

    4. Content & ownership (Web, assessment, demonstrations)

    • Your Input: You are responsible for Input (e.g., assessment answers, messages, files you upload) and warrant you have necessary rights.
    • Output: Subject to these Terms and applicable law, you own the Output we generate for you from your Input (excluding any third-party materials or data you do not own).
    • Similarity: Due to the nature of analytics and pattern recognition systems, similar outputs may be generated for different users.
    • Feedback: If you provide feedback, you grant Alethia a non-exclusive, royalty-free, worldwide, irrevocable license to use it to improve the Services.

    5. Privacy

    Our Privacy Policy describes how we process Personal Data as a controller, and how we support compliance in processor contexts. For enterprise deployments, the DPA controls. See https://alethia.io/privacy.

    6. Improvement & Fleet Learning

    Enterprise Customer Data: We do not use Customer Data from enterprise deployments to train generalized models or to build features for other customers unless the customer provides explicit written permission (e.g., via DPA addendum) and we apply robust de-identification and aggregation.

    Fleet Learning (cross-deployment insights): With permission and using de-identified/aggregated signal patterns and performance metadata, Alethia may improve detection quality, pattern recognition, and recommendations across deployments—analogous to fleet learning. This never exposes one customer's confidential data to another, and never re-identifies individuals. Customers control participation and can opt out per agreement.

    Web/Assessment/Demonstrations: We may use de-identified/aggregated usage data to improve these Services, with consent where required.

    7. Software & third-party services

    The Services may include client software or SDKs that update automatically. Parts of the Services integrate third-party software, data, or APIs governed by their own terms; Alethia is not responsible for third-party services.

    8. Accuracy & human review

    Analytics and pattern recognition systems are probabilistic and may produce incomplete or inaccurate outputs. You will apply appropriate human review and judgment before relying on outputs—especially for decisions with legal, safety, or material impact. In regulated contexts, you remain responsible for ensuring outputs meet applicable standards and controls.

    9. Intellectual property

    The Services, including the Sensory Intelligence™ platform, modules, methodologies, and site content, are owned by Alethia or its licensors and are protected by law. These Terms do not transfer ownership. You may use Alethia's name and marks only in accordance with our Brand Guidelines.

    10. Fees (if applicable to paid Web features)

    For any paid web features or add-ons you purchase through the site, you agree to provide accurate billing details, pay applicable fees and taxes, and accept automatic renewals unless you cancel. Prices may change on notice for future renewal periods.

    11. Termination & suspension

    We may suspend or terminate access to the web Services if you breach these Terms, if required by law, or to protect the security or integrity of the Services. You may stop using the Services at any time. Enterprise subscriptions are governed by the MSA.

    12. Disclaimers

    THE SERVICES ARE PROVIDED "AS IS." TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALETHIA AND ITS LICENSORS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE. WE DO NOT WARRANT THAT THE SERVICES OR OUTPUTS WILL BE UNINTERRUPTED OR ERROR-FREE.

    13. Limitation of liability

    TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER ALETHIA NOR ITS AFFILIATES OR LICENSORS WILL BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL. ALETHIA'S AGGREGATE LIABILITY RELATING TO THE WEB SERVICES UNDER THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE WEB SERVICE IN THE 12 MONTHS BEFORE THE CLAIM AROSE OR (B) USD $100. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; THESE LIMITS APPLY TO THE MAXIMUM EXTENT PERMITTED.

    14. Indemnity (business users)

    If you are a business or organization, you will indemnify and hold harmless Alethia and its personnel from claims, losses, or expenses (including reasonable attorneys' fees) arising from (a) your use of the Services, (b) your Content, or (c) your breach of these Terms, except to the extent caused by Alethia's willful misconduct.

    15. Dispute resolution; arbitration; class waiver

    Before filing a claim, both parties will attempt to resolve disputes informally by emailing legal@alethiaintel.com and allowing up to 60 days for resolution. If unresolved, disputes will be resolved by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. Proceedings will be by video conference where feasible, or otherwise in the county of your residence, subject to the arbitrator's determination. No class or representative actions may be brought; disputes must proceed on an individual basis. You may opt out of arbitration within 30 days of first agreeing to these Terms by emailing legal@alethiaintel.com. This section does not apply where prohibited by law.

    16. Trade controls

    You must comply with applicable export, sanctions, and trade laws. The Services may not be used in or for the benefit of embargoed countries or restricted parties.

    17. Changes to the services or terms

    We may update the Services and these Terms from time to time. For material changes that adversely affect you, we will provide notice (e.g., email or in-product) at least 30 days before they take effect. If you do not agree to updated Terms, discontinue use.

    18. Miscellaneous

    You may not assign these Terms without our consent. We may assign to an affiliate or in connection with a merger, acquisition, or sale of assets. If a provision is unenforceable, it will be limited to the minimum extent necessary, and the remainder will remain in effect. These Terms constitute the entire agreement regarding the web Services.

    Governing Law & Venue: Delaware law (excluding conflict-of-laws rules). Subject to the arbitration clause, courts in Delaware have exclusive jurisdiction.
